Terms and conditions

Here you will find the terms that govern a stay at Argentario Home: who is letting you the flat, how the request works, how payment is made, what happens if you cancel, the times, who may stay in the flat and the house rules. They are set out in full, so that you read them before booking.

Who is letting you the flat

Argentario Home is the holiday home of Emanuele Ciacchella, the owner and the person who runs the business. Your contract is with him, not with an agency.

Request and confirmation

From the site you send a booking request. Whoever books must be of age and is also answerable for the people they bring with them. It is not a booking yet: we check the calendar and reply to you by email.

Our reply is a proposal and it contains everything you need in order to decide: the dates, the total price of the stay, the tourist tax calculated separately, the price of any extra services you asked for, the amount of the deposit and of the balance with their deadlines, the bank details for the transfer and a copy of these terms, so that you have them in your inbox as well. The proposal is valid for 48 hours: if you do not reply within that time it lapses of its own accord and the dates go back on the calendar. If you accept, from that moment you have 24 hours to pay the deposit and send us the receipt.

Nothing is paid online on the site and you are not asked for a card: payment is by bank transfer. The deadlines and the cancellation terms are below, the same for everyone.

Deposit and balance

If you accept the proposal, the booking is confirmed with a deposit of 30% of the price of the stay — excluding the tourist tax, which is paid with the balance — to be paid by bank transfer within 24 hours of your writing to us that you accept. What counts is the date of the transfer order, not the day the money arrives in the account.

Within those same 24 hours send us the receipt for the transfer: it is what tells us that you have paid, and without it we cannot confirm. As soon as we receive it we reply with theconfirmation email, which is the proof of your booking. The deposit is an advance on the price and is set against the balance; if you cancel, only what is written below applies.

The dates are held for you from the moment we send you the proposal until the payment deadline: during that time we give them to no one else. If the time passes without the receipt the proposal lapses and the dates become available again, with nothing owed by you — if you have changed your mind you need only do nothing, but a message is appreciated.

The balance is to be paid at least 5 days before arrival, together with the tourist tax, and you send us the receipt for this transfer too within 24 hours. If you book less than 5 days before arrival, the deposit and the balance are paid together, still within 24 hours and in any case before you arrive: in that case you are already in the last band of the scale below, so cancellation is no longer possible.

Tourist tax

The City of Rome applies a tourist tax per person per night. It is not included in the price of the accommodation: we count it together with the stay and we pay it to the City ourselves, so you do not have to bring it separately on arrival. The amount is the one set by the City and we give it to you in the proposal itself, together with the exemptions and the maximum number of taxable nights laid down by the municipal regulation. At the end of the stay we issue you a receipt for what you have paid under this heading: it is a separate document from the price of the flat.

If you cancel

Cancellation is notified in writing to [email protected] and what counts is the day your email reaches us. The days are counted backwards from the day of arrival, which is not counted: if you arrive on the 20th, «up to 10 days before» means by the 10th, «between 10 and 5 days before» means from the 11th to the 15th, «less than 5 days before» means from the 16th onwards.

  • Up to 10 days before arrival: no penalty, we return the deposit in full.
  • Between 10 and 5 days before arrival: the deposit stays with us as the price of the cancellation, that is 30% of the stay. Nothing else.
  • Less than 5 days before arrival: cancellation is no longer possible and the full price of the stay is due. This applies also if you do not turn up without telling us.
  • If we are the ones to cancel for a reason that depends on us — a calendar mistake, a change of mind — we give you back everything you have paid and, on top of that, a sum equal to the deposit: it is the double provided for by article 1386 of the Italian civil code, and it applies in every band. The case of force majeure, where the flat cannot be used for reasons that depend on no one, is under Liability.

If you leave earlier than planned the nights not taken are not refunded.

One clarification that avoids misunderstandings: for accommodation booked for specific dates the law does not provide the 14-day right of withdrawal that applies to online purchases (it is the exception in article 59, paragraph 1, letter n, of the Italian consumer code). The deadlines above are the ones that apply, and you will find them again in the email with the proposal.

Arrival and departure

  • Check-in from 3 p.m.
  • Check-out by 10 a.m.
  • You let yourself in with the smart lock: you do not have to meet anyone or wait for someone to open the door. We send you the instructions to get in before your arrival, once we have the balance and the online check-in of every guest.

Check-in is done online, before you arrive

Before your arrival we send you a link for the check-in: you register the details and the identity document of every guest, children included, and in a few minutes it is done. It is not an idea of ours: we are required to report to the police headquarters who sleeps in the flat within 24 hours of arrival (article 109 of the Consolidated Law on Public Security), and doing it beforehand saves you time on the day you arrive.

Until the check-in is complete for everyone we cannot send you the instructions to get in. How we handle these data is explained in the privacy policy.

Number of guests

The flat sleeps four people at most: three adults, or two adults and two under-18s. On top of these, a child up to 3 years old can sleep in the cot and does not count towards the total.

The number of guests must be stated in the request and cannot be exceeded. If it changes after confirmation, write to us before you arrive: every guest has to be registered with the security authorities and declared to the City for the tourist tax, so one extra person is not a detail we can sort out afterwards.

Who may enter the flat

Only the people named in the request and registered at check-in may enter and stay in the flat. Putting up anyone else — even for a single night, even free of charge, even a friend dropping by to sleep — requires our consent, asked for and obtained beforehand.

It is not a formality: we are required to report to the police headquarters who sleeps in the flat, and an unregistered person puts us outside the law. If we find unauthorised people in the flat we write to you and ask you to put it right at once. If it happens again, or in serious cases, we may end the stay early for breach of these terms: the remaining nights are not refunded, by way of penalty, and any damage is paid for separately.

Use of the flat

The flat is given over for the stay of the registered guests and for the period stated in the confirmation only. The place is yours and that of the people who register with you: it cannot be passed on to others, not even in part and not even free of charge. Residence or a registered office may not be established there, nor may commercial or professional activities be carried on.

House rules

  • Pets are not allowed. Guide dogs and assistance dogs, which the law protects, are the exception: say so in your request.
  • There is no smoking in the flat.
  • No parties or events.
  • The building’s quiet hours are from 10 p.m. to 8 a.m. and from 2 p.m. to 4 p.m.
  • Commercial photography is not permitted.

The flat is in a small private building where other people live. We ask you to treat the flat and the neighbours as you would at home.

If something breaks

Things break, it happens. If it does, write to us straight away: this goes for an appliance that stops working or for a fault you did not cause, too. A problem reported in time gets repaired during the stay.

Damage to the flat, the furnishings or the fittings caused by guests or by anyone who comes in with them is borne by the person who booked: we ask you to reimburse it by bank transfer, at the actual cost of the repair or the replacement, documented with receipts. Normal wear and tear is not included, that is what simply gets worn by living in a home.

After your departure we check the flat. If we find damage you had not reported to us we write to you within fifteen days with the photographs, the description and the cost, so that you can have your say before paying anything.

In the same way, and always at the actual, documented cost, the guest bears the cost of keys not returned or needing to be replaced, of a locksmith made necessary by improper use of the lock, and of extraordinary cleaning if the flat is left in a state that goes beyond ordinary tidying.

No security deposit

We hold no security deposit against damage: apart from the deposit that confirms the booking and the balance of the stay we ask you for nothing in advance, we block no amount on your card and we have no way of taking anything of our own accord. The bill arrives only if there is damage, stating what happened and what it cost to put right.

Extra services on request

Some things are not included in the stay, but you can ask for them before your arrival or during it. They carry an extra cost, which we tell you before providing them.

  • Late check-in.
  • Late check-out.
  • Change of bed linen.
  • Change of towels.
  • Extra cleaning.

Stays of more than 30 nights

On request we consider stays of more than 30 days. Beyond that threshold the paperwork changes and the terms may differ from these: we set them out for you beforehand, and what we agree in writing prevails over this page.

Before you leave

  • Gather up the used towels.
  • Take out the rubbish.
  • Switch everything off.
  • Return the keys.

Liability

For the things you bring into the flat we are liable within the limits the civil code lays down for those who provide accommodation (articles 1783 and following). We cannot exclude this liability by a clause, and we do not do so. There is, however, no safe in the flat: as for money and valuables, you are best not leaving them in sight, and other people also pass through the common areas of the building.

We are not liable for disruptions that do not depend on us — interruptions to electricity, water, gas or internet attributable to the suppliers, works in the building decided on after the confirmation, transport strikes — but we do what we can to put things right quickly. If works in the building are already planned when we confirm, we tell you beforehand. If a disruption of this kind makes the flat genuinely hard to live in for several days, we reduce the price in proportion.

If for a reason of force majeure the flat could not be used, we let you know as soon as we know it ourselves and we give you back what you have paid for the nights not taken. Where we can, we help you find similar accommodation in the area.

What contract you are entering into

Argentario Home is a holiday home, that is a non-hotel accommodation business notified to the City Council and entered in the national database with the National Identification Code IT058091B4HKHPPTRZ. What you are entering into is not a tenancy: it is a contract of hospitality for the confirmed period, governed by Italian law.

If you are a consumer, any disputes fall to the court of the place where you reside or have elected domicile. But before it comes to that: if something is wrong, write to us at [email protected] and we will look for an agreement. We do not belong to an alternative dispute resolution body; if you would rather propose one, we will consider it.
