This page explains how we handle the personal data of anyone who visits argentariohome.it, writes to us or sends a booking request. It is the privacy notice required by article 13 of the GDPR. The terms of the stay are in the terms and conditions.
Who handles the data
The data controller is Emanuele Ciacchella, Argentario Home, via Monte Argentario 5, 00141 Rome, Italy — VAT no. IT12684921005, telephone +39 06 5654 9382. For any question about this notice, or to exercise the rights described below, write to [email protected].
What data we collect
From the contact form we collect what you send us. Only your name, an email address and the message are required: without them the request will not go through. The dates, the number of guests and the telephone number are optional, but we need the dates to tell you whether the flat is free.
If you send us the details of the people travelling with you, or if you later do the check-in for everyone, this page applies to them too: please ask them to read it.
Requests reach us by email and are not stored on the website. Nothing is paid on the site, so we do not ask you for a card or any other payment details: your request is read and confirmed by a person, and the rest is agreed by email.
For each request we also record the date, the time and the IP address it came from: this serves only to tell people apart from automated submissions. Like every website, moreover, our server and Cloudflare record on each visit the IP address and some technical details of the browser, for security and to deliver the pages; on the contact form Cloudflare’s anti-spam check reads some characteristics of the browser to work out whether you are a person. These are technical data, they are kept for a few days and we do not use them for anything else.
We use no statistics, behavioural analysis or profiling tools. There is no advertising, there are no marketing cookies and the data are not passed to anyone for commercial purposes.
Why we handle them
- To reply to you and manage the booking: this is what it takes to reach the accommodation contract and to perform it.
- To keep the site running and defend it from spam and attacks: this is a legitimate interest of ours.
- To report the guests’ details to the police headquarters and to the City Council and for the tax obligations of the stay: this is a legal obligation (article 109 of the Consolidated Law on Public Security, the City of Rome’s tourist tax regulation, tax rules on the retention of documents).
There are no automated decisions and no profiling: requests are assessed and confirmed by a person.
Who else sees them
The data are not disseminated. Besides the controller, they are handled only by the companies that make the site and the email work: the company that hosts the server, Cloudflare, which protects the site from automated traffic and attacks, Google, through which the emails are sent, and the service that manages the online check-in and the transmission of the data to the police headquarters. They work on behalf of the controller and are bound by contract to use the data only for that service. Apart from these cases, the data leave us only where the law requires it or to defend a right before a court.
Cloudflare and Google are United States companies: where their service involves a transfer of data outside the European Union, this takes place with the safeguards provided by the GDPR, namely the European Commission’s standard contractual clauses and the EU-US adequacy framework.
The reports required by law
When a booking is confirmed and the stay takes place, two reports do not depend on any choice of ours and cannot be objected to.
To the police headquarters. Check-in is done online before arrival: each guest registers their own details and identity document on an external service that helps us do this as the law requires, and the personal details are transmitted to the police headquarters within 24 hours of arrival, as article 109 of the Consolidated Law on Public Security provides. We have no use for copies of the documents beyond the transmission; we keep the receipt of the submission for the time laid down by public security legislation. Without check-in we cannot host you.
To the City Council. For the tourist tax we report the number of guests and of nights.
How long we keep them
- Requests that do not become bookings: as long as it takes to reply to you and in any case no longer than twelve months.
- Confirmed bookings: for the duration of the stay and then for the ten years for which the law requires accounting documents to be kept. The emails exchanged to organise the stay follow the same term, because they are the evidence of the contract.
- The data transmitted to the police headquarters and to the City Council stay with those authorities, under their own rules.
Once these terms have expired the data are deleted, except those needed to defend a right in court.
Cookies
The site uses only technical cookies: those it needs in order to work — remembering the dates you searched for, holding together the steps of a request — and those that protect it from attacks. There are none for statistics, profiling or advertising, and for these your consent is not required. The full list is in the cookie policy.
Your rights
At any time you can ask us to see the data we hold about you, to correct them, to erase them, to restrict their use, to receive them in a machine-readable format or to object to processing based on legitimate interest. These are the rights under articles 15 to 22 of the GDPR.
There is one limit, and it is set by the law: the data already transmitted to the police headquarters or to the City Council, and those that tax legislation requires us to keep, we cannot erase on request.
To exercise them an email is enough, to [email protected]: we reply within a month, and if the request is a complicated one we may take up to three, but we tell you straight away. If you believe your data are not being handled properly you can turn to the Italian data protection authority, the Garante per la protezione dei dati personali (garanteprivacy.it), or to a court.
